Terms of Service

1. Acceptance of Terms

By accessing or using the StitchSwitch website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Definitions

"Service" refers to the StitchSwitch website, file conversion tools, and related content.

"User", "You", and "Your" refers to the individual accessing or using the Service.

"We", "Us", and "Our" refers to StitchSwitch.

3. Use License

Permission is granted to use the Service for personal and commercial file conversion purposes. However, you agree NOT to:

  • Modify, copy, or reverse engineer the software underlying the Service.
  • Use the Service to convert malware, viruses, or harmful code.
  • Attempt to bypass any limitations, security features, or rate limits imposed by the Service.
  • Scrape, mine, or automatically harvest data from the Service without written consent.
  • Use the Service for any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by StitchSwitch at any time.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. STITCHSWITCH MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.

We do not warrant that the conversion results will be perfect, error-free, or compatible with every specific embroidery machine model. The mathematical conversion of vector data to stitch data can result in loss of fidelity.

5. Limitation of Liability

IN NO EVENT SHALL STITCHSWITCH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Embroidery Specific Liability: Embroidery machines are complex mechanical devices. We are not responsible for needle breaks, thread nests, garment damage, or machine malfunctions that occur while running converted files. You agree that it is your responsibility to execute a test stitch on scrap fabric before running a final production piece.

6. Intellectual Property Rights

Your Files: We claim no intellectual property rights over the files you upload to the Service. You retain full ownership of your designs. By uploading files, you warrant that you have the right to process such files and that they do not infringe on the copyright of third parties.

Our Service: The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of StitchSwitch and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

7. Third-Party Links and Ads

Our Service contains links to third-party web sites or services (including Google AdSense advertisements) that are not owned or controlled by StitchSwitch. StitchSwitch has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

8. Modifications to Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We also reserve the right to modify these Terms at any time.

9. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
